Being accused of a criminal offense can be one of the most frightening experiences of a person's life. It is important that an experienced attorney fully evaluate and investigate your case for all possible defense, and to make sure your rights are protected. You have an absolute right to remain silent and not give any statements without an attorney. You should never give a statement to the police without an attorney present. The police are trained in special techniques to try to trick you in to talking, and they are even allowed to lie to you during questioning. Often the police will act like they are trying to help you--they are not. They are trying to build a solid case for the prosecutor. Even if you are completely innocent, the police will sometimes try to trick you into confessing.

You should invoke your right to remain silent and have an attorney present anytime you are read your rights or questioned by a police officer. Simply tell the officer: "I am invoking my right to remain silent and to have an attorney present." The officer should stop questioning you if you properly invoke your rights. Also, ask if you are free to leave, and, if the officer says yes, then get up and leave. Do not stay around to help them build their case.

You should never consent to a search of your home, car, or person. Even if threatened, tell the officer you will not give consent. Don't help them convict you.
